RESERVATION POLICIES/AGREEMENT

RENTAL ACKNOWLEDGMENT:

Guest acknowledges and understands that he(she) is a licensee of the Owner and not a tenant; and that he(she) is not acquiring any interest in the property. It is understood that each unit is privately owned including the furnishings, with Eden Crest Vacation Rentals, Inc. acting solely as Agent for the Owner. We reserve the right to refuse service at our discretion.

VERIFICATION:

A copy of the Guest'(s) driver's license is required at check in, plus a copy of any credit cards used to pay for rentals or packages.

USE OF PREMISES:

Occupancy and use of premises shall not be such as to disturb or offend neighbors or residents. The Agent has the right to terminate this agreement and to ask disruptive guests to vacate the premises with no refund of rent paid.

CHECK IN/CHECK OUT:

The Guest(s) understand and agree that check in time is no earlier than 4:00p.m. and check out time is no later than 10:00a.m. with no exceptions. An additional night stay will be charged for late checkouts. The Group Planner(s) must arrive prior to 8:00p.m.. Late arrivals must be prearranged for any group. Guest(s) agree to abide by all guidelines given at check in. A valid credit card must be presented and imprinted upon arrival as security against damages.

USE OF THE PREMISES:

Group Planner(s) understand they are solely responsible for any property damage, accident, injury to any person(s) or loss sustained by any person, including loss of money, jewelry and other items of personal property, arising out of or in any way related to Guest(s) use of the premises, or the items of personal property provided by Eden Crest Vacation Rentals, Inc. on behalf of the owner at Guest(s) request. Guest(s) shall inspect and be familiar with proper use and application of such items in the home prior to using them. Guest(s) hereby agrees to INDEMNIFY and hold Eden Crest Vacation Rentals, Inc. and/or homeowner harmless from any and all claims including those of third parties, arising out of or in any way related to Guest(s) use of premises of the items of personal property provided therein. Guest(s) assumes the risk of injury or other losses relating to any recreational activities and will hold owner and its agents harmless with respect thereto.

DAMAGE/THEFT:

Guest(s) agrees to leave the premises in a clean, undamaged condition. If unit is not left in the same condition the Guest(s) found it in, the Guest(s) understands and agrees that Agent reserves the right to charge the Guest(s) for any repairs or special cleaning. The Guest(s) will provide a credit card upon check in as a security deposit. Guest hereby authorizes the Agent to charge any expenses related to the repairs or cleaning of the unit beyond normal wear and tear or related to theft of any property from the unit to the Guest's credit card on file. Should the Guest(s) dispute the charges or the credit limit on the credit card not be sufficient to cover the theft and/or repairs/cleaning required due to excessive use of the cabin, Agent reserves the right to charge the Guest(s) with vandalism and pursue collection from the Guest(s) with venue being in the county of Sevier, State of Tennessee. All reasonable attorney fees will be at the expense of the Guest(s) should collection become necessary. Missing or damaged items from cabins will be replaced at current retail value plus a minimum $100.00 service fee and charged to the Guest(s), with the Agent reserving the right to adjust the service fee as necessary on a case-by-case basis.

MINIMUM STAYS:

We have a two-night minimum stay on all reservations. Some holiday and other peak season weekends require a 3- or 4-night minimum stay. See our Rates Calendar to view these dates. Online reservations in violation of a minimum night stay will not be processed.

PAYMENT:

At the time of group reservation, 50% of the reservation will be charged to your credit card. The remaining 50% is automatically charged to your card 30 days prior to your arrival. This same policy applies whether you have used a credit card or a debit card. DO NOT mail a check as payment for your balance due unless prearranged. Eden Crest Vacation Rentals, Inc. does NOT accept personal checks. Any change of credit cards must be done through our office if you do not want to use the same credit card for each payment. A processing fee will be incurred if an amount is taken off of one credit card and transferred to a different credit card. Processing fees may be applied if a reservation is changed.

CANCELLATIONS:

Any cancelled reservation is subject to our no-refund policy. We offer cancellation insurance through CSA Travel Protection. In lieu of forfeiture, Eden Crest Vacation Rentals, Inc. at their discretion may offer the guest the option of rescheduling the reservation at a later date with the following rules applied:

  1. The new reservation is at the published rate for the new dates
  2. The cabin's must be managed by Eden Crest Vacation Rentals, Inc.
  3. The extended reservation change must be made no later than 4 weeks prior to the original date of arrival.
  4. The change must be approved by the management of Eden Crest Vacation Rentals, Inc.
  5. The guest must book the new reservation at the time of cancellation and the same cabin(s) must be booked.

HOT TUB USAGE:

Hot tubs will be inspected after each rental. If any items such as soaps, bath products, food, alcohol, etc. are found in the tub, the Guest(s) will be charged a cleaning fee of $150.00. Damage to any cover will result in a $350.00 charge. Covers should remain on the hot tub at all times when not in use. If Eden Crest Vacation Rentals, Inc. is required to drain and clean the hot tub during the reservation, there will be an additional charge to be determined by the circumstances. Guest(s) authorize Eden Crest Vacation Rentals, Inc. to charge the credit card on file for any of the above charges. All hot tubs are drained, cleaned and refilled after every checkout. An additional charge of $50.00 will be added to your reservation to cover this. Guest(s) is not to drain hot tub.

OCCUPANCY:

Cabin occupancy is to be limited to the number of contracted Guests. Allowing others to occupy the cabin's who have not paid will subject the Group Planner(s) to additional fees with appropriate charges made to the credit card on file. The minimum age to reserve a cabin is 21.

CABIN SUPPLIES:

Eden Crest Vacation Rentals, Inc. will provide a starter supply of soap, dishwasher detergent, toilet paper, trash bags and paper towels. All cabins are supplied with linens and towels as well as kitchenware and utensils. All linens, towels, kitchenware and utensils are inventoried upon checkout. The Guest(s) will be charged for any missing/damaged items on the credit card on file.

PETS/SMOKING:

Pets are allowed only in designated pet-friendly cabins, subject to our pet policy and with payment of a non-refundable pet fee. Our pet policy applies if a pet is present in the cabin at any time during a reservation. Smoking is not permitted inside any Eden Crest cabin. Smoking outside or on the decks is permitted. A cleaning fee of $150.00-750.00 will be assessed for any deviation.

MALFUNCTIONS:

Everything possible has been done to insure the cabin is ready for your stay. We strive to maintain the cabin in such a way that you experience a clean and safe cabin. There are circumstances beyond our control and we will make every effort to deal with any malfunctions or break downs. While we cannot refund any monies due to these issues we will respond as quickly as possible to make any repairs or restore services. Agent reserves the right, at their discretion, to move the guest(s) to a similar cabin, should the need arise.

Guest(s) understand and agree that there are circumstances beyond the control of Eden Crest Vacation Rentals, Inc. and that no recourse or action can be brought against Eden Crest Vacation Rentals, Inc. for these circumstances. An example of the type of circumstances is malfunction of plumbing or electrical, construction activity or other instances over which Eden Crest Vacation Rentals, Inc. has no control.

PREPAID RENT:

Prepaid rent is held in an interest bearing account with interest accruing to the benefit of Eden Crest Vacation Rentals, Inc.

PRIVACY STATEMENT:

Eden Crest Vacation Rentals, Inc. does not divulge a guest's personal information to any third party without the guest's expressed consent.

INSPECTIONS:

Most Group Reservations require a departure inspection preformed by Eden Crest Vacation Rentals, Inc. staff. Inspections will be done the morning of departure. Guest(s) must call Eden Crest Vacation Rentals, Inc. office during business hours to schedule inspection. Group Planner(s) must be available to accompany the Eden Crest Cabin Rentals, Inc. staff member on each inspection.

CSA Travel Protection

If you have purchased the Vacation Rental Insurance offered through CSA Travel Protection, your CSA plan covers you for certain unforeseeable events that occur while your coverage is in effect. They include:

Pre-Departure Trip Cancellation Benefits

CSA will reimburse you, up to the amount in the Schedule of Services and Coverages, for the amount of prepaid, forfeited, non-refundable payments or deposits that you paid for your trip.

Reasons for Cancellation and Interruption:

  1. Trip Cancellation or delayed arrival at your destination due to sickness, injury or death of you, your family member or traveling companion that occurs before departure on your trip. The sickness or injury must require the examination by a physician, in person, at the time of Trip Cancellation or delay and be so disabling as to prevent you from taking your trip or delay your arrival on your trip.
  2. Trip Interruption due to sickness, injury or death of you, your family member or traveling companion. The sickness or injury must require the examination by a physician, in person, at the time of Trip Interruption and be so disabling as to prevent you from continuing your trip.
  3. Mandatory evacuation or public official evacuation advisements where there is no mandatory evacuation issued by local government authorities at the insured's destination due to adverse weather or natural disaster. You must have 4 days or 50% of your trip length or less remaining at the time the evacuation ends to cancel or interrupt your trip.
  4. Being involved in a documented traffic accident while en route to your vacation rental.
  5. Interruption of water, electric, sewage or residential or commercial gas services at your destination or interruption of road service, due to inclement weather or natural disaster so as to prohibit you from reaching your destination, for more than 24 hours and only for up to 15 days from interruption of services or until resumption of services, whichever comes first.
  6. Having your military leave involuntarily revoked.
  7. Being called into active military service in the event of a natural disaster.
  8. The primary/secondary school where you attend extends its operating session beyond its pre-defined school year, or starts earlier than its pre-defined school year. Your trip must fall within the extension period.
  9. Being hijacked, quarantined, required to serve on a jury, or required by a court order to appear as a witness in a legal action.
  10. Your home made uninhabitable by fire, flood or natural disaster.
  11. Airplane, bus or train delays resulting from inclement weather, mechanical breakdown or organized labor strikes.
  12. Arrangements cancelled by an airline resulting from inclement weather, mechanical breakdown, or organized labor strikes.
  13. A documented theft of passports or visas.
  14. A transfer of employment of 250 miles or more.
  15. A terrorist act, which occurs in your departure city or in a city that is a scheduled destination for your trip, provided the terrorist act occurs within 30 days of the scheduled departure date of your trip.
  16. Your arrival at your vacation rental is delayed and causes you to lose 50% or more of the trip duration due to the reasons covered under Travel Delay (see below).
  17. Your involuntary termination of employment or layoff that occurs more than 15 days after your effective date and was not under your control.
